1) Agreement to Terms

These Terms & Conditions (the “Terms”) form a binding agreement between you and Kings Crest E-Liquid, LLC (“Company,” “we,” “us,” or “our”). By accessing the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2) Eligibility & Age Verification (21+)

• Products are intended for adults 21 years of age or older. We use age-verification measures and may refuse, cancel, or hold orders pending verification.
• You represent that you are of legal age in your jurisdiction to purchase our products and that any purchase is for personal use only.

3) Health & Safety Disclaimer

• Warning: Certain products may contain nicotine. Nicotine is an addictive chemical.
• Do not use if you are pregnant or nursing, have heart disease, high blood pressure, diabetes, or are taking medication for depression or asthma. Consult your physician before use.
• Keep products out of reach of children and pets. In case of ingestion or adverse reaction, seek medical help immediately.

4) Accounts

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• We may suspend or terminate accounts for suspected fraud, violation of these Terms, or illegal activity.

5) Product Information; Availability

• We strive to display accurate product information, but minor variations in color/appearance may occur.
• We may limit quantities, discontinue products, or change items without notice.

6) Orders, Pricing, Payments, Taxes

• Placing an order is an offer to buy; we reserve the right to accept or reject any order.
• Prices are shown in USD unless stated otherwise and are subject to change without notice.
• You authorize us (or our processor) to charge your selected payment method for the total order amount, including applicable taxes and shipping.

7) Shipping; Risk of Loss

• Shipping times are estimates and not guarantees. Risk of loss passes to you upon carrier acceptance.
• You are responsible for providing a correct, deliverable address and for complying with destination laws/regulations.

8) Returns & Refunds

For hygiene/safety reasons, opened e-liquids and consumables are not returnable. Unopened items may be returnable within 30 days of delivery with proof of purchase, subject to inspection. To start a return, contact support@kingscrest.com. Refunds, if approved, are issued to the original payment method for the product price only (shipping and fees are non-refundable unless required by law).

9) Promotions & Coupons

Promotions are for a limited time, while supplies last, and may not be combined unless stated. We may modify or cancel promotions at any time.

10) Intellectual Property

The Site and its content (including logos, trademarks, text, graphics, video, and code) are owned by Company or its licensors and are protected by law. You may not copy, modify, distribute, or create derivative works without our prior written consent.

11) User Content

If you submit reviews, photos, or other content, you grant Company a worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display such content in connection with the Site, marketing, and operations. You represent that you own or have rights to the content you submit and that it does not infringe others’ rights.

12) Prohibited Uses

• Violating laws or regulations; attempting to purchase for or deliver to minors.
• Interfering with Site security or integrity; introducing malware or scraping without permission.
• Impersonating others; infringing intellectual property; posting unlawful, misleading, or harmful content.

13) Third-Party Links

Links to third-party sites are provided for convenience only. We do not endorse or control those sites and are not responsible for their content, policies, or practices.

14) Disclaimer of Warranties

The Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

15) Limitation of Liability

To the maximum extent permitted by law, Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Site or products. In no event will our total liability exceed the amount you paid for the product(s) giving rise to the claim.

16) Indemnification

You agree to defend, indemnify, and hold harmless Company and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site or products, or your violation of law or third-party rights.

17) Governing Law; Venue

These Terms are governed by the laws of the State of Florida, without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida for any dispute that is not subject to arbitration.

18) Dispute Resolution; Arbitration (Optional)

If you use arbitration language elsewhere, include it here (e.g., AAA or JAMS; class-action waiver). Some claims (small claims, injunctive relief) may be brought in court.

19) Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the new Terms and update the “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance.

20) Termination

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.
